1. Conditions of sale
Unless otherwise agreed by us in writing, these conditions apply to all orders accepted by us for all goods and services provided by us. The seller or leaser or hirer agrees to service the equipments annually, in the manner laid down by the manufacturers. This annual contract price includes: two call-out visits (false alarm condition or not). Only time once on site and repair or replacement parts will be chargeable. Extra call out visits will be charged as per circumstances (i.e. depending on time and distance).
2. Exemption clause
Damage caused to equipment or cables by a third party, deliberate or accidental will be chargeable. Repairs or replacement will be at the discretion of the installer or engineer on call. All the necessary structural damage caused in correcting or installing or replacing equipment or cables, to be put right at the expense of the householder or owner of the premises (i.e. replacing cable in plastered wall which may need redecorating afterwards).
3. Limitation clauses
Liability is limited in this contract in respect to matters beyond the suppliers control, i.e. if and when equipment is damaged or fails and replacement parts are not available for any reason beyond the seller's control, alternative replacement or up-date of older type equipment will be supplied and all extra costs incurred will be chargeable. The seller endeavors to provide prompt service at all times.
4. Disclaimer
All responsibility for damage of faulty equipment is the sole responsibility of the householder or the property owner. Notification must be made as soon as possible of any damage or fault to or in the equipment or cables. This does not alter the responsibility to protect the property by the householder or property owner. Every Endeavour will be made to correct or replace damaged or faulty equipment once notified by the user. Prior notice will be given of a service call and an identification code will be given. This will identify the engineer on call.
5. No responsibility
For false entry by unauthorized person or persons, claiming responsibility or representation of the sellers, i.e. Akousis.com.
6. Drawings, illustrations, etc.
Drawings, illustrations, descriptive matter, weights, dimensions and shipping specifications submitted and the descriptions and illustrations contained in our catalogues, price lists and other advertising material are approximate and by way of identification only and are intended merely to present a general idea of the goods described therein and their use shall not, in any circumstances, constitute a trade by description.
7. Non-acceptance
Goods will not be supplied "on approval". Goods delivered, but found by the buyer to be unsuitable for its purposes may be returned to us only after our written confirmation. We may accept the return of items usually held in stock provided they are returned promptly carriage paid and in a new condition and the price paid for such items will be refunded less a handling charge, provided that the number and date of the appropriate invoice are given on the return note. We will, in no circumstances, accept the return of items listed, but not normally stocked. Each case will be considered according to circumstances and our decision will be final.
8. Fitness for purpose
No warranty is given that the goods supplied are fit for any particular purpose, save insofar as such purpose is defined by us or the goods are supplied to you in pursuance of a written request by you to supply goods for a particular purpose.
9. Our liability in respect of goods supplied
(a)(1) No oral representation by us, our servants or agents, shall be incorporated into this contract. (2) No representation condition or warranty other than such as may be implied by statute, notwithstanding any exclusion thereof by this Agreement shall be incorporated into this contract. (b) Without prejudice to the buyer's rights under section 5 of the Unfair Contract Terms Act, 1977, we shall not be liable for any fault in goods supplied, which fault can be remedied under the manufacturer's warranty and guarantee, unless and until the buyer's remedies under that warranty or guarantee are exhausted or excluded. (c) Save in respect of loss of life and personal injury which liability cannot be excluded by law, we accept no liability for consequential loss of any kind whatsoever.
10. Legal construction
Unless otherwise agreed in writing, the contract shall, in all respects, be construed and operate as an English contract and in conformity with English Law.
